Murder Charges

It’s no surprise that anyone who has been charged with murder faces extreme penalties if convicted. Both murder and manslaughter are serious accusations, and if you’re facing one of these charges, you need to work with a skilled attorney who has proven success defending those charged with murder. 

After being charged, you should contact an attorney immediately. You should not, under any circumstance, talk to the police without a lawyer present. Anything you say could be used against you in court, so if the police ask you questions while your lawyer is not present (they most certainly will), you should politely decline to answer any questions until have the guidance of your attorney.

You could be convicted of manslaughter if you unlawfully kill another person without pre-determined intent. To be convicted of a voluntary manslaughter charge, the prosecution must prove that you intentionally killed a person in the heat of the moment. To be convicted of involuntary manslaughter, the prosecution must prove that you killed another person without intending death. Both voluntary and involuntary manslaughter can carry a penalty of 15 years in prison.

Understanding Your Charges

If you have been accused of first-degree murder, the prosecution will need to prove that you planned the murder (it was premeditated). A first-degree murder conviction will put you in prison for life. 

If you have been charged with second-degree murder, the prosecution is not required to prove the murder was premeditated, but they do need to prove that you killed someone as a result of dangerous conduct and an obvious lack of concern for human life. This charge could also result in a life sentence.
